HARI BABU MAGULURI SC For SERP The Court made the following: :: ORDER :: The above contempt case has been filed complaining of the violation of the order dated 04.10.2024, passed in W.P.No.22608 of 2024. 2. Heard learned counsel appearing on either side. 3. At the hearing, it is brought to the notice of this Court that pending contempt case, the 6th petitioner died and the same is recorded. 4. The petitioners, eleven in number, filed the aforementioned writ petition complaining that the Project Director, DRDA, Eluru District; the Area Coordinator, SERP, Eluru; the Assistant Project Manager, SERF, Lingapalem Mandal; the Cluster Coordinator, SERF, Lingapalem Mandal and Community Coordinator, SERF, Lingapalem Mandal, are interfering with the discharge of their duties as Village Organization Assistants (VOAs) of their respective societies. The said writ petition was disposed of on 04.10.2024, directing the aforementioned respondents not to interfere with the petitioners’ discharge of duties as VOAs of their respective societies. 6. In the affidavit filed in support of the contempt case, it was pleaded that the respondent authorities have violated the order dated 04.10.2024. 7. A counter-affidavit has been filed by respondent No.3. Along with the counter-affidavit, resolutions passed by the respective societies have been annexed. A perusal of the resolutions would indicate that by the resolution dated 26.07.2024, one Smt. V. Neeraja was elected as the new VOA in the place of the 1st petitioner; by resolution dated 15.09.2024, one Smt. T. Manikyam was elected as the new VOA in the place of the 2nd petitioner; by resolution dated 05.09.2024, one Smt. K. Anusha was elected as a new VOA in the place of the 3rd petitioner; by resolution dated 26.07.2024, one Smt. S. Vijaya Kumari was elected as a new VOA in the place of the 4th petitioner; by resolution dated 26.09.2024, one Smt. K. Ramadevi, was elected as a new VOA in the place of the 5th petitioner; by resolution dated 09.08.2024, one Smt. P. Aparna was elected new VOA in the place of the 6th petitioner; by resolution dated 26.07.2024, one Smt. Sunkara Nagamani was elected as a new VOA in the place of the 7th petitioner; by resolution dated 26.07.2024, one Smt. M. Anitha was elected as a new VOA in the place of the 9th petitioner; by resolution dated 27.09.2024, one Smt. D. Venkata Lakshmi was elected as new VOA in the place of the 10th petitioner and by resolution dated 26.07.2024, one Smt. N. Durga was elected as a new VOA in the place of the 11th petitioner. The 8th petitioner has been continuing as VOA in the respective society. 8. No rejoinder has been filed by the petitioners to the counter-affidavit filed by respondent No.3. 9. Thus, as seen from the resolutions annexed with the counter-affidavit, the petitioners 1 to 5, 7, 9 to 11 were replaced with the new incumbents as VOAs. Thus, the contention of the petitioners 1 to 5, 7, 9 to 11 that the respondents are interfering with their discharge of duties is misplaced. Hence, this Court does not find any violation of the order 04.10.2024 passed in W.P.No.22608 of 2024, and the contempt case is liable to be dismissed. 10. Given the facts and circumstances of the case, the Contempt Case is dismissed. Since the 6th petitioner died pending the contempt case, the Contempt Case is dismissed as abated in respect of the 6th petitioner. No order as to costs.
