The petitioner claims that he is entitled to revised salary and its arrears, DA, annual increments and other consequential service benefits of 7th Pay Commission. He has made a representation in this regard but to no avail. The only prayer made by Shri Pramod Kumar Gupta, learned counsel for the petitioner is that representation of the petitioner may be decided within a stipulated period of time. Shri Nagesh Kumar, learned counsel for the respondent nos. 1 to 3 submits that the matter requires determination of facts by the competent authority in light of applicable provisions of law in the first instance. However, he fairly contends that service benefits/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going into the merits of the case, the respondent no.1 is directed to decide the representation of the petitioner regarding grant of revised salary and its arrears, DA, annual increments and other consequential service benefits of 7th Pay Commission in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
