HARINADH NIDAMANURI The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondent Nos.3 and 4 herein in repeatedly interfering in the civil disputes between the Petitioner herein and Respondent Nos.5 to 7 in respect of property admeasuring an extent of 11.8 Ankanams (94.4 Sq.Yards) in House No.15 (Old), New Door 2 No.18, Ward 17, Rayaji Street, Nellore City, SPSR Nellore District without following due process of law as being illegal, arbitrary and without jurisdiction, in violation of Article 21 of the Constitution of India and Consequently direct the Respondent Nos.3 and 4 not to interfere in the civil disputes between the Petitioner herein and Respondent Nos.5 to 7 in respect of property admeasuring an extent of 11.8 Ankanams (94.4 Sq.Yards) in House No.15 (Old), New Door No.18, Ward 17, Rayaji Street, Nellore City, SPSR Nellore District.” 2. Ms.Rithwika, learned counsel for the Petitioner would submit that the Police are interfering with the civil disputes between the Petitioner and the unofficial Respondents. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, regarding the subject property, Crime No.300 of 2021 for the offences under Sections 420, 465, 467, 468 and 471 read with 34 and 109 IPC and Crime No.94 of 2022 for the offences under Sections 447, 427 and 506 read with 34 IPC have been registered. However, the Police are not interfering with the civil disputes between the parties. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the civil disputes between the Petitioner and the unofficial Respondents, except under due process of law. However, it does not preclude the Police to investigate into Crime Nos.300 of 2021 and 94 of 2022. There shall be no order as to costs.
