This writ petition is filed aggrieved by the action of the respondents for non-payment of the bills for the works undertaken by the petitioner. 2. Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development, the learned Assistant Government Pleader for Finance and Planning, and the learned Standing Counsel for the respondent- Municipal Corporation. 3. The learned counsel for the petitioner submits that the 3rd respondent entrusted the contract works to the petitioner under the respective agreements. The details of the works are, (i) providing CC roads from D.No.37/49-M2 to D.No.37/160-8 at S.N. Colony in Ward No.15 of Rayachoty Municipality, under agreement No.518-A/2023-2024, dt.11.12.2023; (ii) providing CC Roads from D.No.37/49-56-2 to D.No.37/49-57-1 at S.N. Colony in Ward No.15 of Rayachoty Municipality, under agreement No.519/2023-2024, dt.11.12.2023; (iii) providing CC Roads from D.No.37/204 to RMC Pole No. 14/49-B Opp Venkateswara Swamy Temple Street, S.N. Colony in Ward No.15 of Rayachoty -3- W.P. No.32332 OF 2025 Date of order:20.11.2025 Municipality, under agreement No.522-A/2023-2024, dt.11.12.2023; (iv) Providing CC Roads from D.No.37/49-14-1 to D.No.37/49-14 and Providing CC Patches from D.No.37/49-14 to D.No.37/49-14A and from RMC Pole No.14/191 to D.No.37/49- 12 at S.N. Colony in Ward No.15 of Rayachoty Municipality, under agreement No.523-A/2023-2024, dt.11.12.2023; (v) Providing CC Roads from Pole No.25/5 to S.N. Colony Entrance in Ward No.15 of Rayachoty Municipality, under agreement No.520-A/2023-2024, dt.11.12.2023; (vi) Providing CC Roads from D.No.37/216-12 to D.No.37/213 & D.No.37/B1-17-12-1 to Pole No.10/9 at S.N. Colony in Ward No.15 of Rayachoty Municipality; under agreement No.522/2023-2024, dt.11.12.2023; (vii) providing CC Roads and Construction of 300mm CC Drain from RMC Pole No.14/42B to D.No.37/B1-17- 11 at S.N. Colony in Ward No.15 of Rayachoty Municipality, under agreement No.519-A/2023-2024, dt.11.12.2023; (viii) Providing CC Road at Pole No.25/10 in ST Colony, CC Patches from Gangamma Temple to Ramalayam Temple, under agreement No. under agreement No.524-A/2023-2024, dt.11.12.2023. 4. The learned counsel further submits that the petitioner duly executed the works to the satisfaction of the 3rd respondent. It is further submitted that after execution of the works, the progress -4- W.P. No.32332 OF 2025 Date of order:20.11.2025 of the works was recorded in the M book. Later, the petitioner submitted respective final bills. The authorities of the 3rd respondent, after the quality check and after fulfilling statutory requirements, approved the respective final bills aggregating to a sum of Rs.34,48,615/- in the year 2024, but so far no payment has been made to the petitioner. 5. The learned standing counsel for the 3rd respondent, on oral instructions, submits that the works undertaken by the petitioner were completed to the satisfaction of the authorities of the 3rd respondent. However, on account of lack of funds, the payment could not be made to the petitioner till now, and that payment would be made in due course. 6. Considering the submissions that the works completed by the petitioner is not in dispute, there shall be a direction to respondents 2 and 3 to verify and release the payments due payable to the petitioner within a period of six weeks. 7. With the above direction, the writ petition is disposed of. No costs. 8. Pending miscellaneous petitions, if any, shall stand closed. ___________________ JUSTICE HARINATH.N BV
