These appeals have been filed under Section 42 of the Prevention of Money Laundering Act, 2002 (hereinafter referred to as, ‘PMLA’), challenging the order dated 30.05.2025 passed by the learned Appellate Tribunal under SAFEMA, New Delhi in the appeals bearing nos. FPA-PMLA-5648/DLI/2023, FPA-PMLA-5649/DLI/ 2023, FPA-PMLA/5650/DLI/2023, FPA-PLMA-5651/DLI/2023, FPA-PMLA/5652/DLI/2023, FPA PMLA/5653/DLI/2023, FPA- PMLA/5729/DLI and FPA-PMLA-5629/DLI/2023 2. The appellants herein neither reside nor carry on business or work for gain in Delhi, and the properties in question are also not situated within the jurisdiction of this Court. The jurisdiction of this Court has been invoked only on the basis that the Appellate Tribunal is situated at Delhi. We have already considered similar contention in This is a digitally signed order. Deputy Director, Directorate of Enforcement, Mumbai & Anr, 2026:DHC:1527-DB, where after examining Section 42 of the PMLA, we have held as under:- “10. A reading of the above provision would show that it is only the High Court where the aggrieved party is residing or carrying on business or personally working for gain, that would have jurisdiction to entertain the appeal. Mere presence of the learned Appellate Tribunal at Delhi would not vest this Court with the territorial jurisdiction to entertain this appeal.” 3. In view of the above, the appeals along with the pending applications are dismissed on the ground of lack of jurisdiction, however, we leave it open to the appellants to avail of their remedies in accordance with law before a Court of appropriate jurisdiction. 4. In case, the appellants invoke such remedy, their entitlement to claim relief under Section 14 of the Limitation Act, 1963 shall be determined by the Competent Court.
