ORDER: The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:
“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declare the action of respondent no.4 in interfering with the petitioner property despite issued house site patta and pattadhar passbook i.e Ac. 0.68 Cents in respect of survey no. 786 situated in Thumbakuppam revenue village, Bangarupalyam Mandal, Chittoor District, as illegal, arbitrary, and violative of the Article 300A and Article 21 of the Constitution of India and Consequently direct the respondent no.4 to not to interfere with the petitioner property, pending disposal of the above Writ Petition and pass...”
2. Heard M/s. Banu Prasad Rao, learned counsel for the petitioner and learned Assistant Government Pleader appearing for respondents.
3. Considering the submissions of both sides, on 02.9.2025 this Court granted interim orders as under: ….Hence, there shall be a direction to the respondents status quo be maintained as on today for a period of six weeks.”
4. Learned Assistant Government Pleader appearing for respondents, on written instructions dated 28.8.2025, submitted that the subject land in Sy.No.317/2 measuring an extent of Ac.659.7 cents classified as UAW as Chinnakonda as per the fair adangal of Thumbakuppam Village. The husband of the petitioner being a Village Revenue Assistant for Thumba Village of Bangarupalayam Mandal by playing fraud he got DKT patta for the suit schedule land in Sy.No.786

of Thumbakuppam Village and for the same an enquiry is going on over the complaint given by the villagers. It is further submitted that after enquiry proper action will be taken as per Rules.
5. Considering the submissions of both sides, the respondents are
directed not to dispossess or interfere with the possession of the petitioner over the schedule property, without following due process of law.
6. With the above observation, the Writ Petition is disposed of. No costs.
