(ORAL) Petitioners are aggrieved by the impugned order dated 18.07.2020 (Annexure P-4) passed by Civil Judge (Senior Division), Tarn Taran whereby application for condonation of delay preferred by respondents – defendants along with application under Order 9 Rule 13 CPC read with Section 151 CPC was allowed without any notice to the petitioners – plaintiffs. 2. Perusal of the impugned order dated 18.07.2020 clearly shows that, without issuing any notice to the plaintiffs, application under Section 5 of Limitation Act preferred by defendants along their application under Order 9 Rule 13 CPC was allowed. Thereafter, notices were issued to petitioners/plaintiffs Harinder Singh and Harshinder Singh through electronic mode and E-mail for 04.08.2020. The order dated 18.07.2020 is, therefore, not sustainable and passed in breach of principles of natural justice and basic principle that no party can be condemned unheard. 3.
