JUSTICE SANDEEP KUMAR ORAL ORDER 6 14-05-2026 Heard the learned counsel for the petitioners and the learned A.P.P. for the State of both the aforesaid cases.
2. The petitioner of both the aforesaid cases seek bail in connection with Bihta P.S. Case No. 516 of 2025 registered for the offences punishable under Sections 309(5), 109, 311, 312, 103(1) of BNS.
3. The allegation against the petitioners is of attempting to loot the husband of the informant and merciless assault. The occurrence is of 28.06.2025. The deceased died on
02.07.2025.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.77715 of 2025(6) dt.14-05-2026 2/2 petitioners are innocent and have falsely been implicated in the present case. The petitioners of both the aforesaid cases are in custody since 03.07.2025 and they have no criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail
6. Considering the merciless assault against the deceased and the nature of allegation against the petitioners, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, both the aforesaid applications are hereby rejected.
8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner
