PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.3 on bail in Crime No.23 of 2024 of Gopalapatnam Police Station, Visakhapatnam City, registered against the Petitioner/Accused No.3 herein for the offences punishable under Section 20(b)(ii)(B) read with Section 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The allegation against the petitioner/accused No.3 is that he was indulged in dealing with in possession of 7 kgs of ganja along with the other accused. The seized contraband is not commercial quantity. After thorough investigation charge sheet has been filed on 13.11.2025. The alleged offence had occurred on 22.01.2024. The petitioner was arrested on 22.10.2025. He has been in judicial custody for the past 30 days. The petitioner is permanent resident of Thotagondiputtu Village, Alluriseetarama Raju District. He has got fixed abode. If he enlarged on bail he may not evade process of law. There are no adverse criminal antecedents reported against the petitioner. No application has been filed seeking for custodial interrogation of the petitioner. Since charge sheet has been filed after thorough investigation, there is no question of threatening the investigation and threatening the witnesses. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.3, this Court is inclined to enlarge the Petitioner/Accused No.3 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/ Accused No.3 shall be enlarged on bail subject to he executing a bond for a sum of Rs.10,000/- (Rupees 3 ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned II Additional Judicial Magistrate, Visakhapatnam. ii. The Petitioner/ Accused No.3 shall appear before the learned trial Court on every adjournment without fail. iii. The Petitioner/ Accused No.3 shall not commit or indulge in commission of any offence in future. _________________________ DR. Y.
