No 20/ Rowdy /SDPO/VZM/ 2023 dated 12.10.2023 under APPM order NO. 600(1) opened against the petitioner, as illegal, arbitrary, unjust, colorable exercise of power and in violation of Article 21 of the Constitution of India and consequently direct the respondents to close the said Rowdy Sheet issued by the SDPO Viziangaram vide C.No.20/Rowdy/ SDPOA/ZM/ 2023 dated 12.10.2023 and remove the photo of the petitioner from the notice board of the Nellimerla Police Station of Bhogapuram Circle and Viziangaram District, and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Pleased to direct the Respondents herein not to call the petitioner to attend before the 4th Respondent police station, in furtherance of Rowdy Sheet proceedings issued by SDPO Viziangaram vide C.No.20/Rowdy/SDPOA/ZM/2023 dated 12.10.2023 and remove the photo of the petitioner from the notice board of the Nellimerla Police Station of Bhogapuram Circle and Viziangaram, pending disposal of the Writ Petition, and to pass Counsel for the Petitioner: 1. GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....pleased to issue a Writ of Mandamus or any other appropriate Writ Order or direction declaring the opening and continuation of Rowdy Sheet vide proceedings issued by SDPO Viziangaram C No 20/ Rowdy /SDPO/VZM/ 2023 dated 12 10 2023 under APPM order NO 6001 opened against the petitioner as illegal arbitrary unjust colorable exercise of power and in violation of Article 21 of the Constitution of India and consequently direct the respondents to close the said Rowdy Sheet issued by the SDPO Viziangaram vide C No 20/Rowdy/ SDPOA/ZM/ 2023 dated 12 10 2023 and remove the photo of the petitioner from the notice board of the Nellimerla Police Station of Bhogapuram Circle and Viziangaram District and to pass” 2. Heard Sri Velury Raghu Ram, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, would submit that the 2 cases registered against the Petitioner were under trial. It is further stated that, to curb and curtail the unlawful activities of the Petitioner in the vicinity, rowdy sheet vide proceedings C.No.20/Rowdy-Sub-Divisional Police Officer/VZM/2023, was opened against the Petitioner. 4. Learned counsel for the Petitioner would submit that 2 cases are under trial against the Petitioner and the petitioner has been falsely implicated under political pressure and requests to allow to Writ Petition. 5. Considering the submissions, the Writ Petition is allowed and the rowdy sheet vide proceedings C.No.20/Rowdy-Sub-Divisional Police Officer/VZM/2023, opened against the Petitioner is hereby set aside. There shall be no order as to costs.
