Crl.O.P.No.15143 of 2025 ORDER The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 178, 179, 180, 181, 182(2) and 205 of BNS R/w 25(1A) of Arms Act, 1959 in Crime No.79 of 2025, on the file of the respondent police, seeks anticipatory bail. 2. The case of the prosecution is that on 31.03.2025 at about 5:00a.m., the respondents received an information that the accused in Crime No.52 of 2025 were found in the A1's farmland; that based on the said information, the respondents went to the scene of occurrence and found that the petitioner along with other accused were in possession of Air Gun, Pistol, walky talky, sickles, laptop, xerox machine, fake RBI seal and cash of Rs.85,000/- (counterfeit currency) along with the imitated Tamil Nadu Police Uniforms. Hence, this case. 3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent, he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. Crl.O.P.No.15143 of 2025 submitted that some of the co-accused were arrested and released on bail; and that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and ready to co-operate for the investigation and prayed for anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.
Side) appearing for the respondent reiterated the prosecution case and submitted that the materials such as Air Gun, Pistol, walky talky, sickles, laptop, xerox machine, fake RBI seal and cash of Rs.85,000/- (counterfeit currency) along with the imitated Tamil Nadu Police Uniforms have been seized from the petitioner/ A17 and other accused; and that the investigation is pending and opposed the anticipatory bail to the petitioner. 5. Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsels, the gravity of offence and the fact that the investigation is still pending, this Court is not inclined to grant anticipatory bail to the petitioner. 3/4 https://www.mhc.tn.gov.in/judis
