Kancharana Srujana, W/o Kumarswamy Aged 38 yrs, Plot No.63 M.I.G.11 , Sector -3- M.V.P.Colony, Visakhapatnam ...Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court May be pleased to pass an Order to Issue a Writ of Mandamus declaring the Action of the Respondents Police particulalry 3rd Respondent trying to Interfere into the Dispute in connection with the Monetary Transaction in between the petitioner as well as un-official Dr.VJP,J W.P.No.5423 of 2022 respondent No.4 on that Calling to the police station , pressurising the petitioner to Settle/ Pay amounts to the un official respondent failinc which they will register a Case as against the petitoin( all are illegal , uilawful , violation of principles of natural justice , it is nothing but an interferring into the Civil Disputes , Violation of Article 14,19,21 of the Constitution of India Consequently to direct the Respondents Police not to Call for nor summon the petitoiner for settlement of an civil dispute even no registration of any crime in the interest of the justice. and to pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased For the reasons stated in the affidavit filed in support of the above Writ Petition it is hereby prayed that this Hontle Court May be pleaed to pass an Order directing the 3rd Respondent Police not to call for to the police station in connection with the Complaint of R-4 i.e., Civil Dispute in between the petitoiner and R-4 even without registration of any Crime pending disposal of the main Writ Petition in the interest of the justice and pass Counsel for the Petitioner: RAVURI LEELA SAI SAMPATH Counsel for the Respondents: GP FOR HOME Dr.VJP,J W.P.No.5423 of 2022 The Court made the following ORDER: 1. Heard Sri R.Leela Sai Sampath, learned counsel for petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for respondents. 3. Learned counsel for petitioner would submit that police are interfering in the civil dispute between the parties. 4. Learned Assistant Government Pleader for Home would submit that police are not interfering in the civil dispute between the parties. 5. Recording the same, the writ petition is disposed of. However, police are directed not to interfere in the civil dispute, except under due process of law.
