Hon’ble Shri Justice Parth Prateem Sahu
Order on Board 17/11/2025
1. Heard.
2. Petitioner-in-person submits that land was acquired for the respondent No.8, however, at the time of acquisition, permission was granted by the Water Resources Development to the Tehsildar for acquisition by making a condition that the respondent No.8 shall make necessary arrangement for irrigation of nearby lands either by underground, pipeline or by bore-wells. Due to acquisition and surrounding of the land by the boundaries on the land acquired in favour of respondent No.8 about 35 agriculturist are affected. When no arrangement is made by the respondent No.8 of way and irrigation,i.e., the water channel, petitioner submitted a complaint before the Collector, District Janjgir-Champa (C.G.) upon which, the Collector directed Sub-Divsional Officer (Revenue) to submit its report. Collector vide reminder letter dated 26.12.2024 again directed SDO(R) to submit its report, however, even after lapse of about more than 10 months, the Sub-Divsional Officer (Revenue) has not submitted its report, and therefore, direction be issued to respondent No.5/Sub-Divsional Officer (Revenue) to submits its report before respondent No.4/Collector and further direction to the respondent No.4 to take decision expeditiously, thereafter on the representation of the petitioner.
3. Learned State counsel submits that he is not having copy of the writ petition.
4. Petitioner-in-person submits that copy of petition was sent through e-mail to the Office of Advocate General.
5. Be that as it may, the grievance of the petitioner is that the Sub-Divsional Officer (Revenue) is sitting over the letter of the Collector, wherein Sub- Divsional Officer (Revenue) is directed to submit its report on the facts as mentioned therein. Even after lapse of about more than 10 months, of reminder letter of Collector, Sub-Divsional Officer (Revenue) has not
3 submitted its report, and therefore, instead of keeping this writ petition pending, I find it appropriate to dispose of this writ petition at this stage, directing respondent No.5/Sub-Divisional Officer (Revenue) to submit its report, based on the reminder letter of the Collector dated 26.04.2024 expeditiously, preferably within a period of 6 weeks from the date of receipt of copy of this order. It is further directed that upon submission of report by the respondent
No.5/Sub-Divisional
Officer
(Revenue),
respondent No.4/Collector shall further take decision on the representation/claim of the petitioner expeditiously, preferably within a further period of 3 months.
6. With the aforesaid observations and directions, the instant writ petition stands
disposed of. Sd/-
