1. The applicant has preferred this third bail application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as she is arrested in connection with Crime No. 152/2019 registered at Police Station – Torwa,
2 District Bilaspur (C.G.) for the offence punishable under Sections 21 (c) and 22(a) of the N.D.P.S. Act.
2. The prosecution case, in brief, is that on 03.05.2019, on the information of informant, the police had seized 166 Ampules Injection, 50 Nos Avil Bottles, 76 Nos. Nitrojepam Tablets and 50 Nos. Syrings from the possession of the applicant. On the basis of above, offence has been registered and the applicant was arrested.

Learned counsel for the applicant submits that earlier vide
order dated 09.03.2020 in MCRC No.514/2020, the applicant was granted regular bail by this Court imposing certain conditions but due to non-communication of further dates of hearing by the Trial Court counsel, the applicant could not appear on 19.03.2025, 18.06.2025, 17.09.2025 and 10.10.2025, as such, the bail granted to the applicant was jumped. The aforesaid mistakes on the part of the applicant is bona-fide. Learned counsel also submits that the applicant neither committed nor participated in any such act, which may amount to any of the offence. Therefore, the applicant may be extended privilege of regular bail again.
4. Counsel for the State however opposes the application for regular bail. Learned counsel submits that the applicant has
3 no criminal antecedents.
5. Considering the totality of the facts and circumstances of the case and further considering order dated 09.03.2020 passed in MCRC No.514/2020, I am inclined to release the applicant on regular bail.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on her executing a personal bond in the sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the trial Court. She is
directed to appear before the trial Court concerned on each and every date given to her by the said Court.
7. It is directed that the learned Trial Court would be at liberty to forfeit the earlier bail bond furnished by the applicant. Sd/-
