Court No. - 5 Case :- WRIT - A No. - 6718 of 2025 Petitioner :- Kuldeep Upadhyay Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Birendra Kaushik Counsel for Respondent :- C.S.C.,Suresh Singh Hon'ble Ajay Bhanot,J. The petitioner claims appointment on compassionate grounds. A representation in this regard has been made before the competent authority but to no avail. The only prayer made by Shri Birendra Kaushik, learned counsel for the petitioner is that the representation of the petitioner for grant of appointment on compassionate ground may be decided within a stipulated period of time. Shri Suresh Singh, learned counsel for the respondent nos. 2 to 5 and, learned Additional Chief Standing Counsel submit that the matter requires factual determination including the financial status of the family and other relevant factors as per applicable laws and holdings of constitutional courts by the competent authority in the first instance. However, he fairly contends that the purpose of appointment on compassionate ground will be defeated in case the same is not processed in a reasonable period of time. In wake of the submissions made at the Bar and without going into the merits of the case, the respondent no. 4 is
directed to decide the representation of the petitioner for grant of appointment on compassionate ground in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
