...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue a writ, order, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent in receiving and entertaining the document for registration in Survey Nos. 399/1 and 339/B under Application dated 31-05-2025 inspite of Petitioners representation dated 06-06-2025 bringing to their knowledge that petitioners are the lawful owners and that the Hon'ble High Court of Madras in C.S No. 124 of 1994 vide its order dated 19-02-2024 directed to elect a new board of trustees and vested all the properties and the power regarding anterior and subsequent claims of purchasers of various properties of the trust made by original American Baptist Foreign Mission Society (ABFMS) and Property Association of Baptist Churches (PABC) in the said board as arbitrary, illegal, in violation of Article 300A of the Constitution and well settled principles of natural justice and further restrain the 4th respondent from receiving or registering any document in respect of Survey Nos.
399/1 and 339/B, Markapur Town, Prakasam District and to pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the 4th respondent to restrain from receiving or registering any document in respect of Survey Nos. 399/1 and 339/B in Markapur Town, Prakasam District pending disposal of the above writ petition and to pass such Counsel for the Petitioner(S):

ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue a writ, order, or direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the 4th respondent in receiving and entertaining the document for registration in Survey Nos. 399/1 and 339/B under Application dated 31-05-2025, in spite of the petitioners’ representation dated 06-06-2025 bringing to their knowledge that the petitioners are the lawful owners and that the Hon'ble High Court of Madras in C.S. No.124 of 1994, vide order dated 19-02-2024, directed the election of a new Board of Trustees and vested all the properties and the power regarding anterior and subsequent claims of purchasers of various properties of the trust made by the original American Baptist Foreign Mission Society (ABFMS) and Property Association of Baptist Churches (PABC) in the said Board, as arbitrary, illegal, in violation of Article 300A of the Constitution of India and well-settled principles of natural justice, and further restrain the 4th respondent from receiving or registering any document in respect of Survey Nos. 399/1 and 339/B, Markapur Town, Prakasam District, and to pass…” (in verbatim). 2. After notice, the official respondents have filed a counter affidavit. According to the counter affidavit, the subject property has already been entered in the prohibitory properties register and, therefore, the document presented for registration of the subject property was rejected. 3. In view of the above averments and as the authorities have already considered the request made by the petitioners, the present Writ Petition is closed.
If the petitioners are aggrieved by the action of the respondents in entering the subject property in the prohibitory properties register, it is open to

them to question the same in appropriate proceedings in accordance with law. There shall be no order as to costs. Consequently, miscellaneous applications pending, if any, shall stand closed. __________________ JUSTICE D. RAMESH
