Petitioner has filed this writ petition seeking following reliefs. “10.1 That, the Hon’ble Court may kindly be pleased to direct the respondent authorities to call the entire records pertaining to its case. 10.2 That, this Honb’le Court be pleased to issue an appropriate writ by directing the respondent to rectify the date of birth as 06.08.2002 in place of 06.08.1998 in the class 10th mark sheet of the petitioner according to the hospital record as well as birth certificate issued by the competent authority. 10.3 Any other relief or relief(s) which this Hon’ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.” 2. Learned counsel for the petitioner submits that petitioner upon finding discrepancy in his date of birth mentioned in mark-sheet of Class-10th and the date of birth mentioned in the document issued by the hospital where PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 birth of petitioner took place, had submitted an application before respondent-CGBSE, Raipur. However, the application submitted by petitioner till date is pending consideration. 3. Learned counsel for respondent submits that according to his information, appropriate authority to consider such grievance is Dy. Controller, CGBSE, Raipur and the application is to be submitted online along with requisite fee and if such an application is submitted, it is to be considered in accordance with law. Petitioner has not filed any document to show that he submitted any application before Dy. Controller, CGBSE, Raipur and paid requisite fee, hence, no relief can be granted to petitioner in this regard. 4. Having considered the submission made by learned counsel for the respective parties, in particular the submission made by learned counsel for respondent that according to the regulations there is prescribed formate for submitting application and further that as of now mode of submission of application is online apart from physical mode along with requisite fee. In the opinion of this Court, petitioner has not submitted application before the competent authority in the prescribed formate and therefore, I find it appropriate to disposed of this writ petition at this stage permitting the petitioner to submit application for redressal of his grievance as prayed with regard to correction of date of birth in the record of CGBSE, Raipur in the mark-sheet of Class-10th, before the competent authority along with requisite fee and if such an application is submitted by petitioner, Dy. Controller of respondent shall consider the same in accordance with law, expeditiously preferably within a further period of 04 weeks from the date of receipt of application. 5.
