05/16.07.2025 The present writ petition has been filed for issuance of direction upon the respondent no. 1 to consider and grant Arms Licence to the petitioner in terms of Section 13 of the Arms Act, 1959, as the petitioner’s father Late Radhe Shyam Gupta was already having an Arms Licence bearing No. I-6627/82, Ranchi and after his death in the year 2003, double barrel gun was deposited with the Arms dealer and the petitioner is regularly paying rent in respect of the said gun to the Arms dealer. Further prayer has been made for declaring that the petitioner is entitled for grant of Arms Licence in terms of the Arms Act, 1959. 2. Mrs. Sweta Shukla, AC to AAG-II appearing on behalf of the respondents, refers to paragraph nos. 9 and 10 of the counter affidavit filed on behalf of the respondent nos. 1 and 3, which read as under:
“9. That vide letter no. 306, dated 16.06.2023, the answering respondent has sought for a report from the respondent no. 2 to provide investigation/verification/ opinion regarding the actual threat of life against the petitioner as the petitioner is already possessing an arms licence for an NP bore revolver/pistol so that further

action can be taken upon the request made by the petitioner for issuance of licence of S.D.B.B.L gun. 10. That it is stated and submitted that as no investigation report/opinion has yet been obtained by the answering respondent, vide letter no. 191, dated 26.03.2024, a reminder letter was sent by the answering respondent to respondent no. 2 to provide a report so that further action can be taken upon the pending application of the petitioner.”
3. Considering the aforesaid stand taken in the counter affidavit filed on behalf of the respondent nos. 1 and 3, the respondent no.
2 is directed to submit the report/opinion to the respondent nos. 1 and 3 positively within two weeks. The respondent nos. 1 and 3 are directed to take decision on the petitioner’s application seeking Arms Licence within two weeks thereafter. 4. The writ petition is accordingly disposed of.
