The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.612/2024, registered at Police Station – Balod, District - Balod (C.G.) for the offence punishable under Sections 318(4), 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023. 2. As per the prosecution story, the complainant lodged a report at Police Station Balod, District Balod (C.G.). It is alleged that the complainant made allegations against the applicant stating that, for agricultural work PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.11.19 18:56:11 +0530 2 and large investments, the applicant assured commission and formed groups of rural women, and loans were taken from various banks. It is further alleged that the entire loan amount was withdrawn and kept by the applicant, but he did not deposit the loan installments in the bank, thereby cheating an amount of Rs.36,13,000/-. On the basis of the report lodged by the complainant, the police of Police Station Balod investigated the matter and registered Crime No. 612/2024 for offences punishable under Sections 318(4), 61(2), and 3(5) of the BNS. After completion of the investigation, the police of Police Station Balod, District Balod registered the crime against the applicant and filed the charge-sheet before the competent court. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that on the basis of memorandum statement of the accused person, the applicant has involved as accused in connection of the crime based upon baseless allegation. Even the name of the present applicant has not mentioned in the FIR. He also submits that the charge-sheet has been filed in this case and the applicant is in jail since 13.03.2025 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4. On the other hand, the learned State Counsel opposed the bail application and submitted that the charge-sheet has already been filed. He further submits that there are five cases have been registered against the applicant including the present one, one of which, i.e., Crime No. 77/2024 registered at Police Station - Rudri, District - Dhamtari (C.G.) for offences under Sections 318(4), 3(5), and 61(2) of the BNS, in which the applicant was involved, the applicant had filed a bail application (MCRC 3 No. 7643/2025), which was rejected by this Court on 30.10.2025, hence, the applicant appears to be a habitual offender, furthermore, in the present crime number, bail applications of two co-accused persons have already been rejected in MCRC No. 4048/2025 and MCRC No. 4688/2025, therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that five cases have been registered against the applicant including the present one, one of which, i.e., Crime No. 77/2024 registered at Police Station Rudri, District - Dhamtari (C.G.) for offences under Sections 318(4), 3(5), and 61(2) of the BNS, in which the applicant was involved, the applicant had filed a bail application (MCRC No. 7643/2025), which was rejected by this Court on 30.10.2025, hence, the applicant appears to be a habitual offender, furthermore, in the present crime number, bail applications of two co-accused persons have already been rejected in MCRC No. 4048/2025 and MCRC No. 4688/2025, this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Rakesh Kumar Jangde involved in Crime No.612/2024, registered at Police Station – Balod, District - Balod (C.G.) for the offence punishable under Sections 318(4), 61(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 4 9.
