PUBLIC PROSECUTOR (AP) CRIMINAL PETITION No: 610 of 2024 ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”)/under Section 528 of Bharatiya Nagarik Suraksha Sanhitha (in short, “BNSS), has been filed by the Petitioners/ Accused to quash the proceedings in C.C.No.96 of 2023 on the file of Judicial First Class Magistrate, Paderu, for the offences punishable under Section 509 of I.P.C. r/w 34 of I.P.C. 2. Heard Sri Robba Nani Babu, learned counsel for the petitioner and Learned Assistant Public Prosecutor for respondent No.1-State and Sri S.V.S.S.Siva Ram, learned counsel for respondent No.2. 3. Considering the submissions and fair look at the material placed before this court, the Police after conducting investigation came to the conclusion that no offence made out for trespass and causing mischief but altercation took place on the date of alleged incident wherein the petitioner scolded some words against the respondent No.2. In that view, they filed charge sheet for the offence punishable under Section 509 I.P.C. 4. Learned counsel for respondent No.2 would submit that the offence under Section 509 is made out and this is not a fit case of quashment. 5. Considering the submissions, the record would show that as rightly pointed by learned counsel for respondent No.2 that there is verifiable material which requires investigation and full length of trial are present. Hence, this is not a fit case for quashment. 6. Accordingly, this criminal petition is dismissed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. __________________________________________ DR.
