CORAM: HONOURABLE MR. JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 2 04-08-2025 Heard learned counsel for the petitioners and learned APP for the State.
2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Jalalpur P.S. Case no. 283 of 2024 instituted for the offence under Sections 126(2), 115(2), 118(2), 109, 352, 351(2) and 351 (3) of the BNS, 2023.
3. The case of the prosecution is that the petitioners entered into the shop of the informant and assaulted the wife and sister of the informant.

4. Learned counsel for the petitioners has submitted that petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that from perusal of the injury report, it will transpire that the informant has received simple injury caused by heard and blunt substance and there is also a counter version of this case. It is also submitted that the occurrence took place on 06.12.2024 whereas the FIR has been lodged on 20.12.2024. There is delay of 14 days for which there is no explanation on behalf of the informant.
5. Learned APP appearing for the State concede the
submissions put forward by the petitioner stating that the injury is simple in nature.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Jalalpur P.S. Case no. 283 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,
