CRM-M-26736-2025 -1- 217 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-26736-2025 Date of Decision:21.05.2025 Dalbir Singh @ Billa …Petitioner vs. State of Punjab …Respondent Coram : Hon’ble Mr. Justice N.S.Shekhawat Present : Mr. Gobind Singh Randhawa, Advocate for the petitioner. Mr. I.P.S. Sabharwal, DAG, Punjab. *** N.S.Shekhawat J. (Oral) 1. The petitioner has filed the present petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant anticipatory bail to him in case FIR No.43 dated 10.04.2025, registered under Sections 118(1), 118(2), 115(2), 190, 191(3), 351(2) of BNS, at Police Station Sultanwind, Amritsar, Police Commissionerate Amritsar, District Amritsar. 2. Learned counsel for the petitioner contends that as per the allegations levelled by the complainant, the petitioner had allegedly caused injuries with a Kirpan to Harjit Singh, complainant and his brother, namely, Gurbhej Singh. However, the injuries, which are attributed to the petitioner, have been declared to be simple in nature. He further contends that in fact, the complainant party had attacked Manjinder Singh @ Kalu and other accused with deadly weapon. Even the accused side had moved a complaint to the police for getting the FIR, but no FIR has been registered by the police, even though, Manjinder Singh @ Kalu had suffered serious injuries on his person. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that the petitioner is involved in a serious crime and he alongwith his co-accused had caused injuries to the complainant and his brother. However, he does not dispute the fact that the injuries caused by the petitioner have been declared to be simple in nature. 4. I have heard learned counsel for the parties and perused the record. 5. Admittedly, the injuries caused by the petitioner have been declared to be simple in nature. Moreover, Manjinder Singh @ Kalu on the side of the petitioner had also suffered injuries on his person. It is a case of version and cross-version and the question of aggressor is yet to be decided by the trial Court, during the trial. 6. Without commenting any further on the merits of the case, the present petition is allowed. The petitioner is granted concession of anticipatory bail, subject to the conditions as provided under Section 482(2) of the BNSS. It will be open for the Investigating Officer to call the petitioner to join investigation, if so required, by issuing a written notice in this regard and he shall abide by the conditions mentioned in Section 482(2) of the BNSS.
