Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order or orders particularly in the nature of Writ of Mandamus declaring the action of the respondents in not paying the petitioner salary arrears attached to the Post of Principal is illegal arbitrary, unconstitutional and violative of article 14, 16, 19 and 21 of the Constitution of India and also discriminative, consequently directing the respondents to pay the Petitioners arrears of eligible salary attached to the post of Principal and also the consequential benefits as entitled by the Petitioner and pass such other order.

ORDER:
1. The present Writ Petition has been filed questioning action of the Respondents in not paying the Petitioner’s salary attached to the post of Principal as illegal, arbitrary.
2. The Petitioner was appointed as Lecturer in SGL Degree College in the year 1983 and then he was admitted into grant-in-aid post with effect from 06.10.1990. While so, the Petitioner was promoted as Principal in the year 2002 and the same was intimated to the Director of College Education, Hyderabad. However, as there was some disturbance in the College, the Education Department has transferred all the aided staff i.e., both teaching and non-teaching staff to other aided and Government colleges holding the Petitioner continued for the post of Principal.
3. Thereafter, as the salary of the Petitioner was not being paid, the management of the College filed W.P.No.22422 of 2022 challenging the Proceedings of the Respondents in not paying the salary to the Principal/Petitioner and the same was allowed on
04.03.2011. The said order was assailed by the State in W.A.No.673 of 2012 and the same was confirmed. Thereafter, the

Petitioner was paid salary, however, not in terms of UGC Revised Pay Scales, 2006 as revised in the year 2010.
4. In the course of time, the Petitioner had retired from service in the year 2016 and had been representing to the authorities to fix the anomaly in the pay as adopted by the State Government vide G.O.Ms.No.38, Higher Education (UE) Department, dated
23.06.2016.

It is submitted that the Director of Education on 20.08.2025 called for the Service Register and other requisite information from the Regional Joint Director of Collegiate Education, Rajahmundry regarding the Pay Record for considering the representation of the Petitioner for rectification of anomaly in the cadre of the Principal. Pursuant to the same, the Regional Joint Director of Collegiate Education, Rajahmundry, in turn called for the relevant particulars from the Correspondent of SGL Degree College and the management in turn submitted the service particulars as sought vide Letter dated 17.09.2025.
6. Smt.P.Laxmi, learned Assistant Government Pleader would submit that appropriate decision will be taken by the Respondent- authorities in the light of the receipt of Service Register and other

requisite information from the College Management within a reasonable time.
7. Considering the submissions made, the Writ Petition is
disposed of with the following directions;
(i) The Respondent-authorities are directed to consider the
representation dated 17.02.2025 submitted by the Petitioner
regarding rectification of pay anomaly for the post of Principal,
as expeditiously as possible, preferably within a period of (8)
weeks from the date of receipt of a copy of this order;
(ii) No order as to costs.
8. As a sequel, pending applications, if any shall stand closed.
