Petitioners are engaged in Forest Department through an outsourcing agency since last more than a decade. According to them, even after putting in such long continuous service against various Group-D posts, their claim for regularisation is not being considered. Their further grievance is that the benefit of various labour laws, including Employees Provident Fund and provisions of Employees’ Provident Funds and Miscellaneous Provisions Act and Employees’ State Insurance Act etc. are not being given to them. 4. Learned State Counsel submits that, as petitioners were engaged through a contractor and they were not directly employed by the Forest Department, therefore, this appears to be the reason for the competent authority not considering their claim. 5. Learned counsel for the petitioners submits that petitioners tried to make representations to respondent no. 5, however, their representation has not been accepted. Learned counsel for the petitioners further submits that sufficient number of vacancies on Group-D posts are also available against which 2025:UHC:8113 petitioners can easily be accommodated. 6. Having regard to the facts and also in view of the long service rendered by the petitioners, writ petition is disposed of by directing the respondent no. 5 to accept the representation made by petitioners, if made, within two weeks.
