Neutral Citation No. - 2025:AHC:83198 Court No. - 33 Case :- WRIT - C No. - 15895 of 2025 Petitioner :- Nandlal Respondent :- Rajya Uttar Pradesh And Another Counsel for Petitioner :- Akhilesh Singh,Rahul,Rakesh Singh,Ravish Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. The order dated 19.03.2025 passed by the District Magistrate, Prayagraj whereby the application for grant of firearm license has been rejected, is under challenge.
2. It is argued by learned cousnel for the petitioner that the petitioner is entitled for firearm license pursuant to the Government Order dated 08.10.2018 issued by the State Government. It is further argued that the only reason mentioned in rejection order is that at no point of time any F.I.R. had been lodged by the petitioner or against the petitioner. It is argued that when the petitioner approached for lodging the F.I.R., the same was not lodged and the petitoner filed two complaints under Section 156(3) Cr.P.C. before the Chief Judicial Magistrate Prayagraj which is still pending, hence the reason given in the order is bad in the eyes of law.
3. On the other hand, it argued by learned Standing Counsel that against the aforesaid order, a statutory alternative remedy is available to the petitioner to file appeal before the Commissioner of the Division as provided under Section 18 of the Arms Act, 1959 and in place of approaching this Court, the petitioner should avail the aforesaid remedy.
4. Heard learned counsel for the parties and perused the record.
5. From perusal of the record, it is clear that against the aforesaid order, statutory alternative remedy is available to the petitioner to file appeal as provided under Section 18 of the Arms Act, 1959.
6. In this view of the matter, the present petition is dismissed on the ground of statutory alternative remedy. Order Date :- 19.5.2025 saqlain Digitally signed by :- SYED MOHAMMAD SAQLAIN HAIDER High Court of Judicature at Allahabad
