Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue order or direction more particularly one in the nature of Writ of MANDAMUS directing the Central Administrative Tribunal to hear and dispose the petitioners O.A.No.583/2023 on the file of Central Administrative Tribunal, Vijayawada expeditiously, in the interest justice and pass such IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to the Central Administrative Tribunal to hear and dispose the petitioner’s O.A.No.583/2023 on the file of Central Administrative Tribunal, Vijayawada expeditiously, pending disposal of the above writ petition and pass such Counsel for the Petitioner:

The Court made the following ORDER: (Per Sri Justice Cheekati Manavendranath Roy)
Heard the learned counsel for the petitioner and Sri Narasimharao Gudiseva, learned Standing Counsel for Central Government appearing for the respondents 3 to 6. 2. The petitioner is an employee of Railways, working in Vijayawada Division. It appears that disciplinary proceedings were initiated against him and a punishment of compulsory retirement was imposed. In the appeal preferred by him, the said punishment was modified, and the penalty of reduction to the lower cadre as Technician was imposed, and he was ordered to be transferred to Nanded Division.
Challenging the said order, he approached the Central Administrative Tribunal. 3. Now, the limited grievance of the writ petitioner is that there is urgency in disposing of his application before the Tribunal expeditiously and in view of such urgency, the petitioner seeks a direction to the Central Administrative Tribunal to hear and dispose of his application expeditiously. 4. The learned Standing Counsel for Central Government would submit that the Circuit Bench functions for a period of three days during every third week of the month, and an appropriate direction may be given to dispose of the petitioner’s application and the petitioner can pursue his matter for expeditious disposal before the Tribunal when the Circuit Bench is in session. 4
5. Having regard to the limited grievance of the writ petitioner in the writ petition and in view of the urgency that is urged by the petitioner, this Writ Petition is disposed of with a direction to the Central Administrative Tribunal, Hyderabad to take up hearing of the application of the petitioner at Hyderabad or at the Circuit Bench and dispose of the same on merits as early as possible, preferably within a period of one (1) month from the date of this order, in accordance with law. It is made clear that we have not expressed any view on the merits of the matter. There shall be no order as to costs.
