Learned counsel for the petitioner would submit that initially, the petitioner was appointed to the post of Driver in the Office of Deputy Director Veterinary Services, Korba vide order dated 12.07.2013 on probation for a period of two years. She would further submit that the period of probation was extended by the respondent authorities vide order dated 16.07.2015 on the ground that in the years 2014-15 and 2015-16, the ACRs of the petitioner were found unsatisfactory. She would also submit that the petitioner preferred an appeal before respondent No. 2 against the adverse remarks, but the same has not been decided yet. 3. On the other hand, Mr. Vedant Shadangi, P.L. would submit that the appeal preferred by the petitioner was dismissed vide order dated 07.10.2016 (Annexure R/1), and thereafter, the petitioner moved a subsequent application raising the same grounds and challenging the adverse entries made in the same ACRs of the year 2014-15 and 2015-16, therefore, the instant petition is not maintainable. 4. Taking into consideration the fact that the appeal preferred by the petitioner for expunction of the adverse remark of the ACRs of the years 2014-15 and 2015-16 has already been decided by the authority on 07.10.2016 and the 3 petitioner has not challenged the said order; this petition is not maintainable. 5.
