ORDER:
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the petitioner/accused No.5, seeking quashment of the proceedings pending against him in FIR in Crime No.444 of 2019 of Muvvalavanipalem Police Station, Visakhapatnam City, registered under Sections 489-B, 489-C, 420 and 120-b of IPC pending Trial before the Hon’ble IV Addl. Chief Judicial Magistrate, Visakhapatnam .
2. Heard Sri R.K.Acharyulu,
learned counsel representing Ms.M.K.Tirupama Devi, learned counsel for the petitioner and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Learned counsel for the petitioner would submit that the petitioner herein is A-5. Recently, he came to know about the registration of the case against him arraying him as A-5 in this matter. Learned counsel for the petitioner would submit that Non-Bailable Warrant has been issued to the petitioner. The petition may be disposed of giving liberty to the petitioner to surrender before the concerned Court and move a regular bail application.
4. Learned Assistant Public Prosecutor would submit that investigation is pending in this matter. The question of pendency of Non-Bailable Warrant against the petitioner does not arise.

5. At this juncture, learned counsel for the petitioner would submit that they are withdrawing the contents of the petition regarding the Non-Bailable Warrant. The petition may be disposed of giving liberty to the petitioner to surrender before the concerned Court.
6. Considering the submissions made, this Criminal Petition is disposed of. However, the petitioner being an accused, he can surrender before the concerned Magistrate Court and move a regular bail application. On filing such application, the learned Judge may consider the same and take appropriate decision according to law.
