SREENIVASA REDDY Criminal Petition No.1092 of 2025 Order: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A5 to A8, seeking regular bail, in Crime No.100 of 2024 of RSASTF Police Station, Tirupati district. 2. A case has been registered against the petitioners herein and others for the offences punishable under Section 303(2) read with 3(5), 49, 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 20(1)(d)(i)(a) read with 20(1)(c), ii, iii, iv, x, 36(a) read with 32-A of the AP Forest (Amendment) Act, 2016. 3. Case of the prosecution, in brief, is that, on 23.12.2024, at about 11.00 PM, at Reppalathippa reserve forest area, S.K. Madugu Forest Beat, Beerakuppam Section, Sathyavedu range, Nagalapuram Mandal, A1 to A8 criminally trespassed into reserve forest without permission, cut the live red sander trees, committed theft and trying to shift by loading for the purpose of smuggling red sander logs. They were arrested and 69 red sander logs, weighing about 479 Kgs, Honda Shine motor cycle bearing registration No.TN 20 BD 7353 and seven (7) cell 2 phones were seized from their possession and a case has been registered against them. 4. Heard. Perused the record. 5. Petitioners were arrested on 24.12.2024 and since then they are in judicial remand. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed and only formal charge sheet has to be filed. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioners/A5 to A8 on the following conditions. i) The petitioners/A5 to A8 shall be released on bail on their executing personal bonds for Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of the like sum each to the satisfaction of the learned Judicial Magistrate of First Class- cum-Special Court for trial of cases relating to Red Sanders Smuggling, Tirupati. ii) On release, the petitioners shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 3 iii) Petitioners herein/A5 to A8 shall not go beyond the jurisdiction of Tirupati district, Andhra Pradesh State, without leave of the trial Court and they shall make available their location through mobile phones by pairing them with the mobile phone of the Investigating Officer round the clock. 7.
