With the consent of the parties, the present petition is heard finally at motion stage. 2. The petitioner has filed the present petition under Section 528 of BNSS, 2023 for seeking direction to conclude the criminal trial expeditiously pending before the learned Special Judge (NDPS) Bilaspur, District- Bilaspur (C.G.) in Special Sessions Case (NDPS) No. 27/2023 which is pending since 10.04.2023 and no single prosecution witness has been examined till date. 3. Brief facts of the case are that on 09.02.2023 at 08:30 a.m., based on information received from an informant, it was reported that two individuals were traveling from Janjgir-Champa on a motorcycle bearing registration no. CG 10 AD 4352, carrying an illegal quantity of cannabis (ganja) in a large backpack for the purpose of sale towards Bilaspur. 4. Learned Counsel for the petitioner contended that the case is pending since 10.04.2023 before the Special Judge (NDPS Act), Bilaspur and after passing of more than 2 ½ years, no single prosecution witness has been examined till date. The inordinate delay of over 2 ½ years in examining prosecution witnesses violates the petitioner’s fundamental right to a speedy trial under Article 21 of the Constitution of India. 5. Learned counsel for the State submits that the present petition may be disposed of with a direction to the learned trial court to expedite the trial. 3 6. I have heard learned counsel for the parties and perused the documents with utmost circumspection. 7. Considering the facts and circumstances of the case, particularly the fact that the trial is pending since 10.04.2023 before the trial Court, therefore, the learned Special Judge (NDPS Act),Bilaspur, District- Bilaspur is directed to conclude the trial pending in Special Session Case (NDPS) No. 27/2023, expeditiously as soon as possible, if there is no legal impediment. 8.
