VIMAL VARMA VASI REDDY THE HONOURABLE SRI JUSTICE D.RAMESH ORDER: This Contempt Case has been filed by the petitioner herein in violation of the orders of this Court passed in W.P No. 16612 of 2023 dated 10-7-2023. 2. Sri Posani Venkateswarlu, learned Senior Counsel representing Sri P.Vivek, learned counsel for the petitioner submits that the interim order granted by this Court in W.P.No.16612 of 2023 dated 10.07.2023 has not been implemented in proper and perspective manner. He further submits that this Court has directed the respondents to continue the petitioner’s service in view of the provisions of All India Council for Technical Education Regulations, 2010 and the guidelines of the Andhra Pradesh Admission and Fee Regulatory Committee. According to the said regulations, the petitioner is entitled to be continued till attaining the age of 65 years. Despite the above direction, the respondents have placed the petitioner under suspension on 31.07.2023 i.e., last day of his retirement, at the age of completion of 62 years. Hence, the respondents have violated/succumbed the interim order passed by this Court. 3. As the intention of the respondents is to draw that the respondents are not intending to implement the interim orders of this Court dated 10.07.2023. 4. Learned counsel appearing on behalf of the contemnors submits that the respondents have implemented the orders of this Court and the service of the petitioner has been continued but for taking certain aspects into consideration the petitioner’s services has been placed under suspension. The said proceedings were subject matter of another Writ Petition. 5. Considering the submissions made on both sides, though there is some force in the submissions of the learned Senior Counsel, the fact remains that, as directed by this Court, the respondents have continued, which raises the question of whether the petitioners’ services have been suspended by a separate order. Suspension would arise only when the petitioners are in service. 6. Hence, this Court is of the opinion that there is no clear or willful violation of the orders passed by this Court. If there are any subsequent developments in the matter, those developments do not come under the purview of this contempt case. 7. Accordingly, the Contempt Case is closed. There shall be no order as to costs.
