Petitioner has been made accused in connection with Ichagarh P.S. Case No. 79 of 2023 for the offences registered under sections 20((b) (ii) (C), 25 and 29 of N.D.P.S. Act, pending in the court of learned Additional Sessions Judge-I, Seraikella.
Bail application of the petitioner was earlier rejected by this court vide B.A. No. 1450 of 2024 by order dated 15.05.2024.
During the intervening period of 12 / 13.10.2023, Ichagarh Police on the basis of confidential information, intercepted a trailor bearing registration no. UP 25CT 3786. On seeing the police party, three persons started fleeing away. On chase, petitioner and co-accused persons were apprehended while one of the co-accused managed to escape. On search, 810 kgs. of cannabis were recovered from the vehicle.
It was submitted that nothing was recovered from the possession of the petitioner. From the facts of this case, it appears that the petitioner after seeing the police party, was trying to escape from the vehicle, but on chase, he was apprehended.
Regard being had to the facts and circumstance of the case and considering the fact that commercial quantity of cannabis was recovered from the vehicle on which the petitioner was travelling; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
