PUBLIC PROSECUTOR The Court made the following Order:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/Accused Nos.1,2,4 and 5 to grant anticipatory bail in connection with Crime No.115 of 2023 of Peddamudiam Police Station, Kadapa District. 2 2. A case has been registered against the petitioners herein and others for the offences punishable under Sections 403, 409 and 420 read with 34 IPC. 3. Brief facts of the case are that, the accused No.2, Proprietor of accused No.1/warehouse, along with accused Nos.3 to 5 and one late Bapathi Pedda Konda Reddy, approached the City Union Bank, Proddatur town and requested to sanction loans to the farmers, who kept their Bengal gram seeds in accused No.1/warehouse, by pledging warehouse receipt issued by accused No.2; accordingly, the informant bank sanctioned loan to a tune of Rs.7,48,00,000/- to 68 farmers, who kept their produce in accused No.1/warehouse, with a confirmation receipt made in writing by accused No.2 that he shall not lift the stock without repayment of loan and without intimation to the bank; but accused Nos.2 to 5 lifted the entire stock without informing to the bank officials and without payment to the bank, and thereby, accused No.2, being the Proprietor of accused No.1/warehouse along with accused Nos.3 to 5, committed criminal breach of trust and cheating by misappropriating the property. 4. Heard. Perused the record. 5. Earlier bail application in Criminal Petition No.6192 of 2024 filed by the petitioners herein was dismissed by this Court by its 3 order dated 04.12.2024. To entertain the present application filed by the petitioners herein, there is no change in circumstances. 6. Accordingly, the Criminal Petition is dismissed. _________________________ JUSTICE K.
