The instant petition has been filed for the following relief: "issue a writ, order or direction in the nature of mandamus commanding the respondent no.2/ Settlement Officer of Consolidation, Ballia to decide the appeal no.99/ 112 (Ramakant vs. Jairam and others) under Rule 109 (3) of U.P. Consolidation of Holdings Rules, 1954, Village Mauja Rajpur, Pargana Kharid, Tahsil- Bansdih, District- Ballia filed by petitioner dated 25.4.2022 (Annexure No.1 to the writ petition) within stipulated time bound issued by this Hon'ble Court." 3. This Court vide order dated 16.5.2025 directed the learned Standing Counsel to obtain instruction in the matter. 4. In compliance of the order of this Court, instruction dated 24.5.2025 sent by Settlement Officer of Consolidation, Ballia is taken on record. 5. Mr. Ashutosh Kumar Rai, learned Additional Chief Standing Counsel for the State on the basis of instruction submitted that the next date fixed in appeal is 30.5.2025 and matter shall be disposed of in accordance with law expeditiously. 6. Considering the facts and circumstances of the case, the instant petition is finally disposed of directing respondent no.2 to decide the aforementioned appeal in accordance with law after affording proper opportunity of hearing to the parties, expeditiously preferably within a period of two months from the date of production of certified copy of this order before him.
