ORDER :
The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioners/Accused, seeking quashment of the proceedings pending against him in C.C.No.1326 of 2023 on the file of the Judicial First Class Magistrate, Razole of East Godavari District.
2. When the matter is taken up for hearing, learned counsel for the petitioners would submit that, without causing any prejudice to the rights and
contentions of the petitioners, the petition may be disposed of.
3. Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor is in attendance.
4. In that view, this Criminal Petition is disposed of without causing any prejudice to the rights and contentions of the petitioners. The petitioners are at liberty to raise all the contentions before trial Court in his defence. The learned trial Judge may consider and take appropriate decision at appropriate time according to law.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
