GP FOR SERVICES I The Court made the following order: The petitioner, Manager/Revenue Officer Category – III, working as Superintendent, Office of the Commissioner & Director of Municipal Administration (CDMA), Mangalagiri, filed the above writ petition to declare the action of respondent authorities in not considering his claim for promotion to the post of Manager/Revenue Officer Category – II, due to the pendency of a charge memo issued vide G.O.Rt.No.486, Municipal Administration & Urban Development (VIG.II-2) Department, dated 12.07.2017 in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999, as illegal and arbitrary. 2. Heard Sri T.S.N. Sudhakar, learned counsel for the petitioner, and Sri Raju, learned Assistant Government Pleader for Services – I appeared for respondents 1 & 2. 3 3. Learned counsel for the petitioner would submit that charges were levelled against the petitioner vide G.O.Rt.No.486, Municipal Administration & Urban Development (VIG.II-2) Department, dated 12.07.2017, regarding the lapses on the part of the petitioner for the year 2014-2015. Learned counsel would also submit that the Government issued G.O.Ms.No.679 General Administration (Services-C) Department, dated 01.11.2008 and G.O.Ms.No.91 General Administration (Ser.C) Department, dated 12.09.2022, fixing the timelines to complete the inquiry within six months in complicated cases and three months in simple cases, respectively. Learned counsel would further submit that the inquiry officer completed the inquiry; however, the petitioner is not aware whether the inquiry officer submitted a report to the disciplinary authority or not. 4. Sri Raju, learned Assistant Government Pleader, on instructions, would submit that the respondent authorities will consider the petitioner’s case for promotion in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999. 5. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, directing respondents 1 & 2 to consider the case of the petitioner for promotion to the post of Manager/Revenue Officer Category – II in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999, if the petitioner’s case is in the zone of consideration. No order as to costs.
