This is the second writ petition for the same cause of action. Earlier the petitioner had approached this Court through Matter under Article 227 No.15580 of 2024, which was disposed of on 11.12.2024 and following order was passed: "1. This writ petition has been filed seeking a direction upon the Court below to decide 6-C application filed in Original Suit No.329 of 2022 (Manki Devi & Ors. vs. Anil Kumar Singh & Ors.), which is pending since 8th March, 2022. 2. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Civil Judge (Senior Division), Varanasi to decide the temporary injunction application (6-C) filed in Suit No.329 of 2022 (Manki Devi & Ors. vs. Anil Kumar Singh & Ors.), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. 3. With the aforesaid direction, present writ petition stands disposed of. 4. It is made clear that this Court has not adjudicated the case on merit." 2. As the present writ petition has been filed with the same prayer, no relief can be granted to the petitioner as direction has already been issued to the Court concerned on 11.12.2024. 3. In view of the said fact, writ petition stands disposed of. 4. However, the Court concerned is directed to proceed with the matter and comply the order dated 11.12.2024.
