Rep. through S.H.O, Kurnool I Town P.S ...RESPONDENT/COMPLAINANT Petition under Section 437/438/439/482 of Cr.P.C and 528 of BNSS praying that in the circumstances stated in the Memorandum of Grounds of Criminal Petition, the High Court pleased to direct the Respondents to release the petitioners herein on anticipatory bail in the event of their arrest in Crime No. 185/2025 of Kurnool I Town P.S., registered for the offences punishable under Sections 115(2), 118(1), 126(2), 109(1), 351 (2), 79 r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023, and pass Counsel for the Petitioner/accused(S): MEDAPATI SANTOSH REDDY Counsel for the Respondent/complainant: 1. 2 Dr.YLR,J CRL.P.No.9491/2025 Dt:31.10.2025 The Court made the following ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused Nos.1 and 2 for granting of pre-arrest bail in connection with Crime No.185 of 202025 of Kurnool I Town Police Station, Kurnool District, registered for the alleged offence punishable under Sections115(2), 118(1), 126(2), 109(1), 351(2), 79 read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The wound certificate received by the Investigating Officer reveals that the victim suffered only simple injuries. The Petitioner/Accused No.1 is a Corporator. There is a counter case filed by Accused No.1 against the other people, there is a political rivalry in between the Petitioners and the supporters of the de-facto complainant. 4. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioners, this Court is inclined to grant pre-arrest bail to the Petitioners/ Accused Nos.1 and 2. 5. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioners/Accused Nos.1 and 2 they shall be enlarged on bail subject to they executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only), 3 Dr.YLR,J CRL.P.No.9491/2025 Dt:31.10.2025 with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioners/Accused Nos.1 and 2 shall make himself available for investigation as and when required; iii. The Petitioners/Accused Nos.1 and 2 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioners/Accused Nos.1 and 2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioners/Accused Nos.1 and 2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. vi. The Petitioners/Accused Nos.1 and 2 shall surrender his passport, if any, to the investigating officer. If they claim that they do not have passport, they shall submit an affidavit to that effect to the Investigating Officer. _________________________ DR. Y.
