PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A1, A4 and A5, seeking regular bail, in Crime No.455 of 2024 of Proddatur I Town Police Station, Kadapa district. 2 2. A case has been registered against the petitioner herein for the offences punishable under Sections 118(1), 109 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Case of the prosecution, in brief, is that, on 08.12.2024, at about 06.30 PM, while the de facto complainant was dropping his aunt from the Car by stopping the Car at Swayam Sevak road, Proddatur, A1 came on a motor cycle from rear side of the said Car, blew horn continuously to move the Car, abused the de facto complainant in filthy language and went away with grudge. Later, several times, A1 called the de facto complainant by phone through his friends to say sorry. While so, on 15.12.2024, at about 04.30 PM, when the de facto complainant along with his friend Surya Prakash Reddy went to the Gym building in the premises of Arts College, Proddatur town and Mandal, A1 to A5 attacked the de facto complainant with an intention to kill him with beer bottles, stones and cricket bat and caused bleeding injuries on his back side of head, right leg and near right ear. Surya Prakash Reddy also sustained bleeding injury on his right leg finger. 4. Heard. Perused the record. 3 5. A perusal of the material on record goes to show that the accused are alleged to have attacked the de facto complainant with an intention to kill him with beer bottles, stones and cricket bat and caused bleeding injuries on his body. Learned Assistant Public Prosecutor produced the wound certificate of the de facto complainant dated 15.12.2024, wherein it has been categorically mentioned by the Civil Assistant Surgeon that the injuries received by the de facto complainant are grievous in nature. It is also represented that the investigation is not yet completed and some more witnesses are to be examined. 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners/A1, A4 and A5. 7.
