1. This is the First anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.749/2025 registered at Police Station – Kotwali, Korba District – Korba (C.G.) for the offence punishable under Sections 115(2), 296, 3(5), 309(6), 324(5), 351(3) of BNS, 2023.
2. The prosecution story, in brief, is that complaint lodged by Karandeep Singh, S/o. Jagraj Singh on 13.10.2025 at near about 06:10 Hours, the F.I.R. was lodged inter alia on the allegations that, he is the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.11.07 17:38:28 +0530
2 owner of Jashna Resort, Situated at Darri Road, Korba. On 12.10.2025 a cultural program of Sapna Choudhary was organized in his hotel. After completion of the said program Anil Dwivedi (applicant herein) along with Amit Navranglal, Yugal Sharma, Sujal Agrawal have abuse the brother of the complainant namely Snehdip @ Goldi and staff of the resort and assaulted them and has snatched/looted the Laptop, DVR Set and Rs. 10,000/- from reception counter. On the basis of the said allegation the F.I.R. has been registered.
3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is submitted that FIR has been lodged as a counterblast and the allegation levelled against the present applicant is that on 12.10.2025 a cultural program was organized in the resort and after completion of said program present applicant along with co-accused persons have abused and assaulted the complainant’s brother and other staff members. He further submits that other complainant has already been granted bail by learned trial Court in crime No.748 of 2025 vide
order dated 14.10.2025, a copy of the same is annexed herewith as Annexure-A/8. He also submits that there is five criminal antecedent registered against the applicant bearing crime No.03 of 2003 registered at Police Station Darri, District-Korba for the offence under Sections 147, 149, 294, 323 of IPC, in crime No.234 of 2013 registered at Police Station Darri, District-Korba for the offence under Sections 147, 294, 506, 323 of IPC and in crime No.60 of 2014 registered at Police Station Darri, District-Korba for the offence under Sections 294, 506, 323, 34 of IPC, and in all three case applicant has been acquitted and in crime No.279 of 2018 registered at Police
3 Station Darri, District-Korba for the offence under Section188 of IPC and in crime No.74 of 2025 registered at Police Station Darri, District-Korba for the offence under Sections 296, 115(2) of BNS. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel and learned counsel for the Objector opposes the bail application of the applicant and submits that there is five criminal antecedent registered against the applicant, out of which, in three cases applicant has been acquitted and two cases are pending for it’s conclusion, it appears that applicant is a habitual offender, therefore he is not entitled for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and considering the fact that FIR has been lodged as a counter blast and complainant has already been granted bail by learned trial Court in crime No.748 of 2025 vide order dated 14.10.2025, a copy of the same is annexed herewith as Annexure-A/8, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7.
Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Anil Dwivedi on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person
4 acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
