1 THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1086 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.54 of 2024 of Gangaraju Police Station, Alluri Sitharama Raju district. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 111(2)(b) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’) and under Sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that on 02.12.2024 at about 16.00 hours, on credible information, the Sub-Inspector of Police, along with his staff and mediators, rushed to Eedulabayalu Junction, and found A1, A4 to A6 in possession of 400 kgs of ganja. The contraband along with other material was seized under cover of a mediators report and a case has been registered against the accused. 2 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the contraband allegedly seized from the possession of the accused is 400 Kgs of Ganja, which is a commercial quantity. It is submitted by the learned Assistant Public Prosecutor that the investigation is not yet completed and other accused are to be apprehended. This is the second bail application and the earlier bail application filed by the petitioner herein was dismissed by this Court on 07.01.2025. There are no changed circumstances since the dismissal of the previous bail application. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/A1 at this stage. 6.
