D KODANDARAMI REDDY The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.4564 of 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “…to issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring the inaction on the part of the respondent No.3 in registering a crime on the complaint, dated 28-12-2018 submitted by me against the respondents No.5 to 15 as arbitrary, illegal, abdication of the statutory duty cast on him and violative of the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.3 to register a crime against the respondents No.5 to 15 basing on the complaint, dated 28-12-2018 given by me and pass…” (in verbatim) 2. Learned Assistant Government Pleader for Home, on written instructions, submitted that earlier, a case in Crime No. 25 of 2013 vide C.C. No. 148 of 2013 ended in acquittal on 25.02.2019 before the learned Additional Judicial Magistrate of First Class, Punganur. Later, the petitioner made a complaint to the police on 28.12.2018, and on 03.01.2019, the petitioner requested the police not to initiate any action on the complaint presented by her on 28.12.2018, as a case 4 was already registered against the unofficial respondents in Crime No. 25 of 2013. Therefore, the police did not register any case based on the said complaint. The police would initiate action if the petitioner approaches them again with a fresh complaint. 3. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home. 4. In the light of the submissions made by learned counsel for the petitioner and learned Assistant Government Pleader for Home, the writ petition may be closed, giving liberty to the petitioner to approach the police with a fresh complaint, and upon receiving such complaint, the police shall take necessary action in accordance with law. 5. Upon considering the above submissions, the Writ Petition is closed at the stage of admission without going into the merits of the allegations, giving liberty to the petitioner to present a fresh complaint to the police. Upon receiving such complaint, the police shall proceed with the same in accordance with law. There shall be no order as to costs.
