By way of this petition, the petitioner has prayed for following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondents not to cause mental pain by making baseless and false allegations against the integrity of the petitioner. 10.2 That, the respondents should be directed to initiate action against the concerned respondent on the frivolous allegations being leveled against the petitioner. 10.3 Any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.” 2. Brief facts of the case, is that, the petitioner is serving under the respondents as a Constable/GD in the Central Industrial Security Force (CISF), SECL Dipka Unit. The petitioner states that for the past few days, he has been subjected to continuous and unwarranted physical and mental harassment by the respondents, who have been making false and baseless allegations against him, accusing him of having links with Naxalites, providing them training, and receiving an amount of Rs. 80,000/– from them. These false allegations have caused serious damage to the petitioner’s image, character, and reputation in society, resulting in immense mental agony and distress. The petitioner has always performed his duties with utmost devotion, sincerity, and discipline, yet he has been falsely implicated by the respondents 3 without any justification. The petitioner, being an honest, service- oriented, and patriotic employee, is deeply aggrieved by the defamatory conduct of the respondents, which has caused him severe physical and mental suffering. Hence, the petitioner is constrained to approach this Hon’ble Court seeking justice and appropriate relief against such harassment. 3. Learned counsel for the petitioner submits that this Court has already adjudicated a matter of similar nature in WPS No. 8081/2023 vide its order dated 09.10.2023. Therefore, the petitioner’s case also deserves to be considered in the same light and spirit of parity. It is further submitted that the petitioner, who has been discharging his duties with utmost sincerity, honesty, and dedication towards his service, has been subjected to false, baseless, and malicious allegations by the respondents without any substantive proof or justification. He further submits that unwarranted and fabricated imputations, according to learned counsel, are not only contrary to the principles of natural justice but have also caused immense hardship and humiliation to the petitioner. Despite making several written and verbal representations before the concerned authorities, apprising them of the continuous harassment and false accusations, no effective or meaningful action has been initiated by the respondents to redress his grievances, thereby causing grave injustice, severe mental agony, and irreparable loss to the petitioner. 4. On the other hand, learned counsel for the respondents opposes 4 the same. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the submissions made by learned counsel for both parties and upon perusal of the material available on record, it appears that the allegations made by the petitioner are general and unsubstantiated in nature, without any cogent evidence to demonstrate that the respondents have acted in a manner violative of any legal or constitutional right of the petitioner. The grievances projected by the petitioner pertain to service-related issues and alleged harassment, which are administrative in nature and fall within the purview of departmental authorities. This Court, while exercising its writ jurisdiction, cannot enter into disputed questions of fact or adjudicate upon issues requiring factual determination and evidence. Accordingly, in the absence of any material to establish arbitrariness, malafide intention, or violation of principles of natural justice on the part of the respondents, the petition being devoid of merit stands dismissed. 7.
