GP FOR HOME The Court made the following Order: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “… a Writ of Mandamus to declaring the action of the respondents particularly the 4th Respondent in not registering the crime on petitioner’s repeated complaints dated 28.04.2025, 12.05.2025, 14. 07.2025 and 23.07.2025 against the accused who is the 5th respondent, Sub Inspector of Police Pendlimarri Police Station and other involved police personnel in spite of the law laid down by Hon’ble Supreme Court of India in Lalita Kumari vs Govt of U.P. and Ors as illegal irregular irrational amounts to non discharge of legal obligation conferred on them under the provisions of Bharatiya Nagarik Suraksha Sanhita 2023 and offends Articles 14 and 21 of Constitution of India and consequently direct the investigation to be conducted under the supervision of a Judicial First Class Magistrate Kadapa to ensure fairness impartiality and transparency and prosecute the 5th respondent and other involved police personnel for appropriate offences and penal provisions of law and pass”. 2. Heard Sri C.Rajendra, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that basing on the complaint made by the petitioner, the Police are not registering the case against the respondent No.5. 4. Learned Assistant Government Pleader for Home would submit that police have conducted preliminarily enquiry on the complaint made by the petitioner and there is no proof in the allegations mentioned in the said complaint. The petitioner himself visited the police station in a drunken condition to that extent CC footage is also available. Therefore, the Police have not registered a case basing on the complaint of the petitioner. Learned 3 Assistant Government Pleader would further submit that nine crimes are pending against the petitioner. 5. Recording the said submissions, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
