. Neutral Citation No. - 2025:AHC:107144-DB Court No. - 40 Case :- WRIT - C No. - 21103 of 2025 Petitioner :- Pawan Kant Govil Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Navin Kumar Srivastava Counsel for Respondent :- C.S.C.,Kirtika Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Jayant Banerji,J. 1. This petition has been filed with a prayer to direct the concerned authority to pass appropriate orders on petitioner's mutation application, which is stated to be pending consideration before the third respondent since 12.1.2024. 2. Ms. Kirtika Singh, appearing for the respondents, contends that there is a serious dispute of title in respect of the property in question and since various civil litigations are subsisting, therefore, the authority concerned has not passed any orders in the matter. 3. Law is well settled that mutation proceedings are summary in nature and any orders passed by the authority in such proceedings remain subservient to the adjudication made by the competent civil court. Merely because civil dispute is pending in respect of the property in question, it would not mean that statutory authority enjoined with the duty to pass appropriate orders on the mutation application would not deal with the issue or would not pass any orders upon such application. 4. In this view of the matter, we dispose of this petition with a direction upon the third respondent to pass appropriate orders on the petitioner's pending mutation application, after affording opportunity of hearing to the rival parties, within a period of three months from the presentation of a certified copy of this order.
