Counsel for the Petitioners (through online) and Sri Ramalingeswara Rao Kocharla Kota, Ld. Counsel for the Respondents. 2. The Writ Petitioners/Contempt Petitioners have filed two separate Writ Petitions (W.P.No.30901 and 30902 of 2023) challenging the Proceedings bearing Rc.Nos.299/D2/2023-3, 299/D2/2023-4 dated 19.01.2023 and other consequential proceedings as mentioned in the respective prayers in both the Writ Petitions. This Court, having considered all the material, prima facie held in favour of the Petitioners therein and stayed both the impugned Proceedings until further Orders. 3. In view of the stay of the impugned Proceedings mentioned in the prayers therein, the Writ Petitioners were required to be ‘reposted’. Due to non-compliance of the Interim Order passed by this Court dated 29.11.2023, the Petitioners herein have filed the present Contempt Cases (C.C.No.2043 and 2044 of 2024). During the interregnum, the Petitioners herein also got issued a Legal Notice to the Respondents on 09.03.2024 for compliance. 4. It transpires from the record that in compliance with the interim Orders of this Court dated 29.11.2023, the Petitioner in Contempt Case No.2043 of 2024 was ‘reposted’ on 09.05.2024 and the Petitioner in Contempt Case No.2044 of 2024 was ‘reposted’ on 06.05.2024. 5. The sole Respondent No.1 has filed the Counter-Affidavit and has raised certain legal issues insofar as the main Writ Petitions are concerned. It is also stated that the Applications were filed in both the Writ Petitions for vacating the interim Orders dated 29.11.2023. 6. The averments in the Counter-Affidavit filed by the Respondent No.3 namely Sri B.Seshanna, Commissioner, Tenali Municipality would indicate that certain articles of charges have been framed against both the Writ Petitioners. The Counter-Affidavit of the Respondent No.1 would also indicate 5 that an Application for vacating the Interim Orders has also been filed and the same is pending. It is also stated in the Counter-Affidavit that the Petitioners were ‘reposted’ subject to the final outcome in the present Writ Petitions. It is stated in Para-8 of the Counter-Affidavit filed by the Respondent No.1 that to avoid further legal complications in the matter, the answering Respondent had addressed a Letter on 11.01.2024 to the Respondent No.5. It is also stated that the Respondent No.1 has once again addressed a Letter on 25.01.2024 to the Commissioner of School Education by duly submitting a detailed Report with a request to appraise the factual position to the Government i.e., Respondent No.7 for filing Counter-Affidavit. The Respondent No.5 namely the Commissioner of School Education has also addressed a Letter on 24.02.2024 to the Respondent No.7 namely the Principal Secretary to take appropriate decision and issue suitable Orders to avoid legal complications. It is also stated that the Government has also referred the matter to the Vigilance Section (Para- 9 of the Counter-Affidavit) and the matter is still under examination. It is further stated that during the said process, some delay has occurred in complying with the Orders of this Hon’ble Court. 6. Since the facts would indicate that vide Orders dated 09.05.2024 and 06.05.2024, the Petitioners have been ‘reposted’, and that as explained in Para Nos. 8 and 9 of the Counter-Affidavit as regards the occurrence of some delay, this Court is rather satisfied with such Explanation of the Respondents. This Court, therefore, finds that the Orders of this Court has been substantially complied with and no further consideration is required in these Contempt Cases, and that the grievance of the Petitioners in these Contempt Cases has been redressed. The parties are free to raise all contentions in the pending Writ Petitions since this Court has not expressed any opinion on the merits of the cases. 7. Accordingly, both the Contempt Cases are disposed of. No orders as to costs. 6 8.
