Also heard Mr. Kohinoor N. Bhattacharya, learned G.A. appearing for the respondents-State. [2] This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- “i) Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to provide the Petitioners the benefit of MACP-II w.e.f. 28.12.2022. (ii) Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to give benefit of increment w.e.f. 01.07.2008 by giving effect of absorption w.e.f 01.07.2008 and or by one time relaxation in terms of memorandum, dated, 01.09.2017 and 13.10.2017 respectively. (iii) Issue Rule upon the Respondents to show cause as to why writ in the nature of Mandamus and/or order/orders and/or direction/ directions of like nature shall not be issued whereby directing the Respondents to give the benefit of Movement/ promotion from Grade V to Grade V (Senior Level) on completion of 4 years regular service w.e.f. 28.12.2009 instead of 02.01.2012 as per Sub-Rule-2 of Rule 30 of TAAS-2007. (iv) Make the rules absolute. (v) Call for records. (vi) Pass any further order/orders as this Hon'ble High Court considered fit and proper.” [3] Heard and perused the evidence on record. [4] After perusal of the record, it is seen that the petitioners herein submitted representations dated 28.08.2024 and subsequent thereto, reminder letters dated 19.11.2024 addressed to the concerned respondent, ventilating their hardships but till date the same are pending for adjudication. [5] In view of such circumstances, without expressing any opinion on the merits of this case, this writ petition is disposed of, directing the respondent(s) to consider the case of the petitioner in light of the representations dated 28.08.2024 and reminder letters dated 19.11.2024 in accordance with law within a period of 03(three) months from the date of receipt of the copy of this order. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
