HON’BLE SRI JUSTICE K. SREENIVASA REDDY Criminal Petition No.1104 of 2025 Order: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/Accused, seeking regular bail, in Crime No.950 of 2024 of Nallapadu Police Station, Guntur district. 2. A case has been registered against the petitioner herein for the offences punishable under Sections 78, 96, 351(2) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’) and 12 of the Protection of Children from Sexual Offences Act, 2012 (for short ‘the POCSO Act’). 3. Case of the prosecution, in brief, is that, prior to 09.12.2024, while the victim, aged about 16 years, was returning from the School, the petitioner/accused used to follow and harass her in the name of love. On 09.12.2024, at about 09.30 AM, the petitioner/accused went to the college of the victim, called her and threatened her with dire consequences that if she does not love and marry him, he would post her photos and videos in social media. Based on the report given by the mother 2 of the victim, the present crime has been registered against the petitioner/accused. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the petitioner is following the victim (LW.3) on the pretext of marrying her, as he was in love with her. On the date of incident, the petitioner is alleged to have gone to the Institution, where LW.3 was studying and by introducing himself as her elder brother summoned her from out of the Institution and threatened her with dire consequences that if she does not marry him, he would post her photos and videos in social media. Petitioner was arrested on 17.12.2024 and since then he is in judicial remand. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. 6. In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/Accused on the following conditions. i) The petitioner/Accused shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the 3 satisfaction of the learned Special Judge for trial of offences under the POCSO Act, Guntur district. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. iii) It is made clear that if the petitioner follows the victim (LW.3) and threatens her further, the bail order, granted by this Court today, shall stand cancelled automatically without any further reference to this Court. 7.
