ORDER:
The writ petition is filed under Article 226 of Constitution of India with the following prayer for:
“….may be pleased to issue any writ order or orders directions, more particularly one in the nature of writ of Mandamus declaring action of the respondents 3 and 4 without giving any notice or opportunity to the petitioner and without following due process of directed the petitioner to evict the petition schedule house situated in survey No. 96- 5A at Utukur Village, Parigi Mandal, Anantapur District is illegal, arbitrary and against the principles of natural justice as well as against constitutional Law, consequently directing the respondents 3 and 4 not to interfere in the petition schedule property without following due process of law of the petitioner and pass such…”
2. Heard
learned counsel for the petitioners, learned Assistant Government Pleader for Revenue, and learned Assistant Government Pleader for Home.
3. When the matter was taken up for hearing, the learned Assistant Government Pleader for Revenue brought to the notice of this Court that the subject land is Government land. It is further submitted one Smt. Nagaratnamma, W/o G. Narasimhappa, and Sri Nagendrappa, S/o G. Narasimhappa, residents of Utakuru Village, Parigi Mandal, filed O.S. No.81 of 2010 before the Court of the Additional Junior Civil Judge, Hindupur, against Shankarappa, S/o G. Kariyappa, and others of the same village. Upon
consideration of both oral and documentary evidence, the Court held that the
plaintiffs were not in possession of the disputed property shown within the HAJI points in the plaint plan, as the said property is Government land. Consequently, the suit was dismissed without costs. It is also submitted that the Village Secretary, Mandal Revenue Inspector, Mandal Surveyor, and Village Revenue Officer inspected the disputed road area and directed the petitioner to vacate the illegally occupied portion of the road to avoid inconvenience to the public. It is further contended that the petitioner produced manipulated documents to mislead the Court and prays to dismiss the writ petition.
4. Sri V.Farooq, learned Assistant Government Pleader for Revenue would submit that they have nothing to do with the subject property, as the matter is civil in nature.
5. Considering the submissions, the writ petition is disposed of. However, the respondent authorities are directed to follow due process of law while evicting the petitioners from the subject property. There shall be no order as to costs.
