1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1.
This hon’ble court please to issue a writ of mandamus directing respondents No. 2 to 5 to take immediate action on complaints of the Petitioners and to register FIR against Respondents No. 6 and 7 under IPC sections 420, 467, 468, 471 etc. 10.2) This hon'ble court please to issue direction to the respondent authorities to decide the representations (Annexure P/1) before granting any approval/NOC/consent to Respondent No. 8 company for setting up industry in village Alda, in view of the Gram Sabha decisions. 10.3) This hon'ble court please to issue direction to initiate departmental/disciplinary proceedings against officials who have failed to act despite repeated complaints. 10.4) This hon'ble court please to grant any other relief(s) deemed fit in the interest of justice.”

Learned counsel for the petitioners submits that the petitioners have submitted an application before the Collector, District Raipur being aggrieved by the grave instance of fraud, forgery and misrepresentation in the land records of the Gram Panchayat of Village Aldha, Tahsil- TIlda- Nevara, therefore, direction be issued to the Respondent No. 2/ Collector,
3 District Raipur to take decision and appropriate proceedings be drawn in this regard. 3. I have heard learned counsel for the petitioners. 4. Bare perusal of the representation submitted by the petitioners and perusal of the relief clause would show that the petitioners have sought a relief of a direction to register an FIR and perusal of the representation would also show that the petitioners want legal action against the respondents No.7 & 8. Further the contents of the complaint would also show that the allegation against the respondents No.7 & 8 are of cheating and forgery. In the opinion of this Court, the petitioners are having the remedy available under law for redressal of their grievance or of filing of complaint case before the Court of competent jurisdiction. 5.
In view of the aforesaid, since the petitioners have an alternative and efficacious statutory remedy available under law, this Court is of the considered opinion that the present writ petition is not maintainable. Accordingly, the same stands dismissed. Sd/- (Parth Prateem Sahu) Judge S.Bhilwar
